Patent registration is an important step to protect intellectual property rights and exploit the commercial value of new inventions. Below is the detailed process for registering a patent in Vietnam performed by A Dong IP:

Step 1: Search and Preliminary Consultation on the Ability to Register Inventions/Useful Solutions 

Before proceeding with registration, it is very necessary to search and preliminarily evaluate the feasibility of the invention. We'll assist you: 


- Look up novelty and creativity: Check if your invention is unique and has never been registered before. 

- Industrial Applicability Assessment: Determine whether your patent can meet the protection standard.


Step 2: Post-Search Consultation and Write Description 

Based on the results of the search, we will: 


- Detailed advice on registrability: Clearly explain the strengths and weaknesses of the invention. 

- Write a patent description: Draft a document describing the invention in detail, including its specifications, how it works, and practical applications. 


Step 3: Prepare the Registration Dossier and Submit it at the National Office of Intellectual Property 

We will assist you in preparing a complete application including: 

- Patent application: Fill in the required information completely and accurately. 

- Description of the invention: Enclosed with drawings or illustrations (if any). 

- Registration fees and fees: Detailed instructions on the fees to be paid. 


The dossier will be submitted to the National Office of Intellectual Property in two forms: 


- Submit in person or by post: To the Department's reception points in Hanoi, Ho Chi Minh City, or Da Nang. 

- Online submission: Register an account and submit an application through the online application system of the National Office of Intellectual Property.


Step 4: Notification of Formal Appraisal Results

The National Office of Intellectual Property will appraise the form of the application within 1 month from the date of submission. The result can be: 

- Accept a valid application: Your application fully meets the formal requirements. - Application rejection: Your application is deficient or does not meet the requirements, needs to be supplemented and corrected. Step 


Step 5: Content appraisal

Once the application is formally accepted, the substantive review process will take place within 18 months. During this period, the National Office of Intellectual Property will: 

- Evaluate the novelty, creativity and industrial applicability of the invention. 

- Request additional information or explanation if necessary.


Step 6: Pay the Patent/Utility Solution Fee 

If your invention meets the protection standards, the National Office of Intellectual Property will issue a patent decision. You will need to pay the prescribed degree fee to receive the certificate. 


Step 7: Reminder of the Validity Period of the Patent/Utility Solution 

The patent is valid for 20 years from the date of filing; utility solution valid for 20 years from the date of application; and should be maintained. A Dong IP will: 

- Remind you of the validity period: Make sure you don't miss any deadlines. 

- Support in paying maintenance fees: Help you complete the relevant procedures to maintain the conservatorship.
