PROPOSAL NOT TO GRANT PART “HQ” IN THE CIRCLE IN TRADEMARK “HQ, HONGQUANINK, DEVICES” WAS REJECTED

Hewlett-Packard Company is the owner of trademarks “HP” and “HP, devices” for products/services in classes 01, 07, 09, 16, 35, 36, 37, 38, 39, 40, 41, 42 in Viet Nam. On 05/4/2017, Intellectual Property Representative of Hewlett-Packard Company in Viet Nam has filed a proposal to the IPO Vietnam for requesting not to grant “hp” in the circle of the trademark “hq, HONGQUANINK, devices” for products/services in classes 35. The objector agrue that part “hq” in the circle of trademark “hq, HONGQUANINK, device” does not meet protection standards according to Articles 74.2e and 74.2i of the IP Laws.

The IPO Viet Nam concluded that part “hq” in the circle  is distinguishable when compared to the registered trademarks of the objector and issued a notice not to accept the opinion of the objector.

After that, the IPO Viet Nam granted TM registration no. 0388322 for “hq, HONGQUANINK, devices”.
