ANNUITY FOR PATENT (FOR INVENTION OR UTILITY SOLUTION) IN VIETNAM

According to the IP Law 2005, amended 2019, the term of validity for a patent is as follows:

- The patent for invention is 20 years counted from the filing date

- The patent for utility solution is 10 years counted from the filing date

- Annuity can be paid in the duration of six months before the due date

- Late paying the said annuity fee is accepted provided that it is not later than 6 months from the due date and the surcharge of 10% per late month is added.

REQUIRED DOCUMENTS FOR ANNUITY OF PATENT IN VIETNAM (THROUGH A DONG IP)

According to the provisions of Circular 01/2007/TT-BKHCN, the below documents are required to renew a Patent (for invention or utility solution) in Vietnam:

- Application for annuity of Patent in Vietnam;

- Power of attorney;

- Other documents (if any).

Time frame and procedure for renewal of Patent in Vietnam: about 4 – 6 months from the filing date.
