State competent agencies shall have the right to call for inspection, assessment on trademark in order to handle those cases accepted by these agencies.

Assignment of patent for industrial design means the transfer of ownership right by owner of such industrial design right to another organization or individual. Assignment of industrial design rights must be established in the form of written contract (herein after referred to as “contract”).

Designs are protected for 5 years from the filing date or the priority date. The owner can renew their protection titles and there are 2 consecutive times of renewals.

Objects of copyright include literary, artistic and scientific works; objects of copyright - related rights include performances, sound recordings, video recordings; broadcasting programs; satellite signals carrying encrypted program.

Licensing of invention/utility solution must be established in the form of written contracts (herein after referred to as “license contract”).

According to the IP Law 2005, amended 2019, the time limit of trademark protection as follows: Trademarks are protected for 10 years from the filing date or the priority date.

The holder of patent for industrial design may request the IPVN to record changes in that protection title in the following cases: change in the name or address of the holder; change of the protection title holder (transfer of ownership on the ground of inheritance, succession, merger, separation, split-up, joint venture, association or establishment of a new legal entity under the same owner, transformation of the business operation, or under a decision of a competent state agency...).

According to the IP Law VietNam the term of validity for a patent is as follows: The patent for invention is 20 years counted from the filing date. The patent for utility solution is 10 years counted from the filing date.
