COPYRIGHT REGISTRATION IN VIETNAM

    THE REQUIRED DOCUMENTS:

    + Declaration for copyright registration (must be written in Vietnamese, signed by the author, the copyright owner, or the person authorized to submit the copyright registration application, and fully state the information of the applicant application, author, copyright owner). The Ministry of Culture and Information controls the format of copyright registration declarations.

    + Two copies of a work with copyright registration or two fixed copies of the subject of related right registration;

    + Power of attorney in case the applicant is an authorized person;

    + Documents evidencing the right to file an application in case the applicant enjoys that right from another due to inheritance, transfer, or inheritance;

    + Written consent of co-authors in case the work has co-authors;

    + Written consent of co-owners, if the copyrights are under joint ownership.

    Note: The above documents must be prepared in Vietnamese, in cases made in a foreign language must be translated into Vietnamese.

    Time for handling: 30 – 45 days counted from the filing date

    WHAT IS COPYRIGHTS?

    Copyright is recognized for literary, artistic, and scientific works such as books, lectures, musical works, theatrical works, and cinematographic works,… Copyright shall arise at the moment a work is created and fixed in a certain material form, irrespective of its content, quality, form, mode, and language and irrespective of whether or not such work has been published or registered.

    SUBJECTS HAVE THE RIGHT TO REGISTER COPYRIGHT

    Organizations and individuals with works that are protected by copyright comprise persons who directly create such works and copyright holders.

    Authors and copyright holders shall comprise Vietnamese organizations and individuals; foreign organizations and individuals with works are published for the first time in Vietnam and have not been published in any other country yet, or with works are also published in Vietnam within thirty days after publication for the first time in another country; and foreign organizations and individuals with works which are protected in Vietnam according to an international treaty on the copyright of which the Socialist Republic of Vietnam is a member.

    TYPES OF WORKS THAT ARE PROTECTED BY COPYRIGHT:

    Literary  and  scientific  works,  textbooks,  teaching  materials,  and  other  works expressed in forms of letters or other writing characters;

    b)         Lectures, presentations and other speeches;

    c)         Journalistic works;

    d)         Musical works;

    đ)         Dramatic works;

    e)         Cinematographic works and works created by similar methods (hereinafter referred to as cinematographic works);

    g)         Fine art works and applied art works;

    h)         Photographic works;

    i)          Architectural works;

    k)         Graphics, sketches, maps, drawings relevant to topography and scientific works;

    l)          Folk artistic and literary works.

    m)    Computer programs and compilations of data

    Note: Derivative works shall only be protected according to paragraph 1 of this Article if they do not infringe the copyrights in respect of the works used to make derivative works.
