Copyright Protection for Works of Computer Program In Vietnam

    WHAT IS WORKS OF COMPUTER PROGRAMS?

    A computer program is a set of instructions which is expressed in the form of commands, codes, diagrams or any other form and, when incorporated in a device readable to computers, capable of enabling such computers to perform a job or achieve a designated result. Computer programs are protected like literary works, irrespective of whether they are expressed in the form of source codes or machine codes.

    THE REQUIRED DOCUMENTS FOR REGISTRATION OF COMPUTER PROGRAMS:

    + Declaration for copyright registration (must be written in Vietnamese, signed by the author, the copyright owner, or the person authorized to submit the copyright registration application, and fully state the information of the applicant application, author, copyright owner).

    + Two copies of CD containing machine codes; two set of Instruction of use;

    + Power of attorney in case the applicant is an authorized person;

    + Documents evidencing the right to file an application in case the applicant enjoys that right from another due to inheritance, transfer, or inheritance;

    + Written consent of co-authors in case the work has co-authors;

    + Written consent of co-owners, if the copyrights are under joint ownership.

    Note: The above documents must be prepared in Vietnamese, in cases made in a foreign language must be translated into Vietnamese.

    Time for handling: 30 – 45 working days counted from the filing date.

    SUBJECTS HAVE THE RIGHT TO REGISTER COPYRIGHT

    Organizations and individuals with works that are protected by copyright comprise persons who directly create such works and copyright holders.

    Authors and copyright holders shall comprise Vietnamese organizations and individuals; foreign organizations and individuals with works are published for the first time in Vietnam and have not been published in any other country yet, or with works are also published in Vietnam within thirty days after publication for the first time in another country; and foreign organizations and individuals with works which are protected in Vietnam according to an international treaty on the copyright of which the Socialist Republic of Vietnam is a member.

    TIME LIMITATATION OF COPYRIGHT OF APPLIED ARTS

    Works of applied art have a term of protection of 50 years from the date of the first publication. For works of applied art that remain unpublished within 25 years from the date of fixation, the term of protection is 100 years from the date of fixation.

    The term of protection specified above expires on December 31st of the year of expiration of the copyright protection term.
