LICENSING OF TRADEMARK

Licensing of a trademark means the permission by the owner of such trademark for another organization or individual to use the trademark within the scope of his/her use right. Licensing of trademark must be established in the form of written contracts (herein after referred to as “license contract”).

According to the IP Laws 2005, amended 2019, license contract of trademark is valid according to the agreement between the parties and is legally valid for a third party regardless of its registration with the IPVN.

REQUIRED DOCUMENTS FOR COMPOSING A LICENSE CONTRACT OF TRADEMARK (THROUGH A DONG IP)

+ Copy of trademark registration;

+ Copy of Written consent of co-owners to the transfer of trademark rights, if those trademark are under common ownership;

+ Document about assignee;

+ Other documents (if any).

Time frame for coposing the license contract: about 04 – 06 weeks.
