LICENSING OF INDUSTRIAL DESIGN

    Licensing of an industrial design means the permission by the owner of such industrial design for another organization or individual to use the industrial design within the scope of his/her use right. Licensing of industrial design must be established in the form of written contracts (herein after referred to as “license contract”).

     

    According to the IP Laws 2005, license contract of industrial design is legally valid for a third party from date IPVN accepts for registration.

     

    REQUIRED DOCUMENTS FOR LICENSING INDUSTRIAL DESIGN (THROUGH A DONG IP)

    According to the provisions of Circular 01/2007/TT-BKHCN, the below documents are required to licensing industrial design:

    + The license contract;

    + Written consent of co-owners to the license of industrial design, if those industrial designs are under common ownership;

    + Power of attorney.

     

    Result: If a dossier for license of industrial design contains no error, the IPVN shall issue a decision on registration of the contract; register and publish it in the Industrial Property Official Gazette. If a dossier for registration of the contract contains errors, the IPVN shall issue a decision on its rejection of the request for license of industrial design.

     

    Time frame and procedure for licensing industrial design in Vietnam: about 6 – 8 months from the filing date.
